Terms & Conditions

Effective and last updated: October 27, 2026

1. Agreement and independent service

These terms govern LocalNewportBeach.NET and its accounts, community features, directory, assistant, and business advertising. By using the service, you agree to these terms and our Privacy Policy. If you do not agree, stop using the service. This is an independent guide, not the City of Newport Beach, an emergency service, or a government agency.

2. Eligibility, accounts, and security

You must be at least 18 to create an account, submit contributions, claim a business, vote, or purchase a package. Provide accurate information, use only accounts you are authorized to operate, and keep sign-in credentials secure. Report unauthorized account activity through our contact form. We may restrict or suspend accounts for abuse, fraud, security concerns, or violations, subject to applicable law.

3. Acceptable use

Do not post unlawful, threatening, discriminatory, defamatory, sexually explicit, deceptive, spam, or infringing material. Do not impersonate others, disclose private information without permission, submit fake reviews, manipulate votes, scrape contrary to applicable rights, bypass access controls, introduce malware, or interfere with the service. You are responsible for your submissions and for obtaining consent from people depicted or identified.

4. Community content and moderation

Contributions are reviewed before publication where the feature requires review. Submission does not guarantee acceptance, publication, a prize, a response, or continued availability. We may edit for clarity, reject, remove, or restrict content and accounts for safety, accuracy, rights concerns, or policy violations. Reviews must reflect genuine experience and disclose material relationships. Votes must be genuine; rankings are community/editorial results, not objective certifications. For pet emergencies, contact appropriate local authorities; do not rely on this guide for rescue or urgent response.

5. Your content and permission to publish

You retain rights you own in submitted content. By submitting material for publication, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute it to operate and promote the guide, with service providers acting for us. This permission does not make private contact messages or claim evidence public. You represent that you have the required rights and permissions. Request removal through the contact form; lawful records and copies outside our control may remain.

6. Site content, photography, and external sources

Site branding and original editorial material are protected by applicable intellectual-property law. Third-party photos, Google reviews and attribution, embedded videos, and business marks remain subject to their owners’ rights and source terms. See Photo credits. Do not assume an image is free to reuse because it appears here. The front-page aerial video is AI-generated, not documentary footage. External websites, businesses, creators, and providers are independent; we do not control their availability, policies, or transactions.

7. Business claims and paid placements

Business claims must be submitted by an owner, manager, or authorized representative with truthful evidence. Submitting a claim is not the same as ownership verification. Package pricing is available only after submitting a claim. Purchases use the package description, duration, amount, and applicable taxes shown before payment. Checkout is a one-time payment for a six-month package, not an automatic renewal. A payment record is separate from editorial approval: purchased placement is subject to claim and administrator review, and its placement period starts when activated. Payment alone does not guarantee immediate activation, exclusivity, a category reservation, rankings, traffic, inquiries, sales, or return on investment. Paid/sponsored placement must not be mistaken for an independent customer review.

8. Payments, cancellations, and refunds

Stripe processes payments under its own applicable terms. Confirm all checkout details before purchasing and do not send card details through our contact form. For duplicate, unauthorized, incorrect, unfulfilled, or disputed orders, choose “Business support” and include an order reference, not full payment credentials. Cancellation and refund requests are reviewed against the order, fulfillment status, applicable purchase disclosures, and law. These terms do not impose a blanket nonrefundable rule or waive statutory remedies. Any future renewal or additional charge requires the applicable purchase authorization.

9. Accuracy, AI, and no professional advice

Business details, cached Google reviews, prices, hours, availability, events, gas information, transit, and rankings can change or be incomplete. Verify directly with the original provider before travel or purchase. AI and voice recommendations can be incorrect; they are not legal, medical, financial, safety, or other professional advice. We do not endorse every listed business or guarantee outcomes. User reviews express their authors’ opinions.

10. Promotions and community rewards

No gas giveaway is currently active. Interest registration does not guarantee entry, eligibility, a prize, or a launch date. Any future contest or promotion requires separate official rules describing the sponsor, eligibility, dates, entry method, selection, prizes, taxes, and exclusions before participation. Those rules govern that promotion.

11. Copyright, privacy, and content complaints

Use our contact form and select “Copyright or legal notice,” “Report content,” or “Privacy request.” For a copyright complaint, identify your work, the specific page/material, your authority, your contact details, and statements that your report is accurate and made in good faith; include an electronic signature where required. We will review reports under applicable law. This form does not claim designated-agent registration or automatic statutory safe-harbor status. Do not include other people’s unnecessary private details.

12. Availability, disclaimers, and responsibility

To the extent permitted by law, the guide is provided “as is” and “as available,” without guarantees of uninterrupted access, accuracy, merchantability, fitness for a particular purpose, or noninfringement. We are not responsible for independent businesses’ goods, services, conduct, or external transactions. To the extent permitted by law, we disclaim indirect, incidental, special, and consequential losses arising from use of the guide. Nothing excludes liability or rights that cannot lawfully be excluded, including applicable consumer rights or liability for fraud, willful misconduct, or other protected claims.

13. Disputes, governing law, and changes

Contact us first if you have a concern so we can attempt a resolution; this does not prevent you from exercising legal rights. California law governs to the extent permitted, without overriding mandatory consumer protections that apply to you. These terms do not require mandatory arbitration or waive class-action rights. If a provision is unenforceable, remaining lawful provisions continue to apply. We may change features or terms and will update the date; material changes will be communicated as required. Changes do not retroactively remove rights in an existing purchase.
